Verizon Wireless Settles Motorola V710 Bluetooth Lawsuit

On September 2, 2005, the Superior Court of California in Los Angeles issued an Order preliminarily approving the settlement of this class action. Verizon Wireless' site can help Motorola V710 owners obtain information about the proposed settlement and also help them determine whether they are a member of the settlement class who qualifies for benefits in this case.
The Plaintiffs claim that Verizon Wireless did not accurately disclose that certain Bluetooth features were not supported by the Motorola V710 handset available with Verizon Wireless cellular service. Verizon Wireless contends that its marketing materials were not deceptive and accurately informed customers of the Bluetooth profiles available for the Motorola V710 cellular handset available with Verizon Wireless service.
Based on the information available to them, the attorneys for the class concluded that the proposed settlement is fair, reasonable, and adequate, and that it serves the best interests of class members. The Court has preliminarily approved the settlement.

Class Membership:
The class to whom this notice is being sent consists of all present and former customers of Verizon Wireless who activated Verizon Wireless cellular service for a Motorola V710 cellular handset on or before January 31, 2005.

Claim Form:
Current and former customers who are members of the settlement class (and do not request to be excluded from the class) will need to submit a Claim Form to obtain a refund or credit once the settlement becomes final. You must fully complete and sign the Claim Form and mail it postmarked no later than December 9, 2005, to:

Exclusion From The Class:
If you are a member of the settlement class but do not want to remain in it you must state your request to be excluded in writing to the Verizon Wireless Motorola V710 Settlement Administrator at the address stated above. Your request must be postmarked no later than December 9, 2005.
You must simultaneously mail your exclusion request to the attorneys at the addresses listed at 9(d) of the Notice. If you do not timely request to be excluded, you will be bound by the terms of the settlement even if you do not submit a Claim Form.
Objections to the Settlement:
If you are a member of the settlement class and you do not exclude yourself from the class, you may still object to the settlement or the request for attorneys fees and expenses by objecting in writing to the Los Angeles Superior Court, Department 24, 111 N. Hill Street, Los Angeles, CA 90012. Your objections must be postmarked no later than December 16, 2005.
You must simultaneously mail your objections to the attorneys at the addresses listed at 9(d) of the Notice. If you do not properly file and serve an objection by the required date, any objections you may have to the settlement will be waived.

Users who bought a Motorola V710 have a few options before December 9, 2005:
1. Keep the V710 and receive a $25 credit from Verizon.
2. Return the V710 (including all accessories) for a full refund but keep their service.
3. Return the V710 for a refund and break the service agreement without a termination charge.
4. Ignore everything.
Excellent now I can finally get out of my crappy contract!

I feed bad for the salesmen at Verizon Stores which are going to get charge backs.

I received a claim form from Verizon for my V710 and here are the three options from Section C, SELECTION OF CLASS RELIEF.
1. Keep the V710 and receive a $25 credit on your bill from Verizon. OR
2. Return the V710 with or without acessories for a full refund and break the service agreement without a termination charge. OR
3. Return the V710 with or without acessories for a refund up to the purchase price of a "new phone" but keep their service. ***
*** Verizon dosen't define what a "new phone" is. The deception goes on and on.

I've sent in my info for the class action suit and I'm eager to replace my phone. Does anyone have any idea when we will start to see the actually resolution in action?

I received the paperwork a while ago where I selected which option I would rather take after the settlement, but I have yet to hear anything else. Does anyone know when we will be getting our credits or if they will be sending out the information. Or even someone who I can contact? Thanks so much!

Note: March 16, 2006 a hearing shall be conducted to determine whether to grant final approval to the settlement agreement.
No benefit payments or credits will be made available until after the settlement has become final and non-appealable (March 16,2006).
30 days after The Final Order of Judgment, Verizon will send pre-paid mailers to the Claiming Current Customers (Those who elected to return the V710 and assessories.) Within the pre-paid mailers will be notification and instructions to return within 60 days the phone, assessories and proof of amounts paid for a refund. Then 45 days after the last postmark date of returning the pre-paid mailers, the Settlement Administrator shall notify Verizon of the amount of the refund. Verizon will then have 30 days to mail the check or refund..
By my understanding it will be a while before we see anything.
Ruff Calculation (based on my understanding)
3/16/2006 Order
4/15/2006 sending of pre-paid mailers
6/14/2206 end date to return the mailers
7/29/2006 Settlement Administrator notifies Verizon
8/28/2006 Verizon sends refunds. (If we are lucky)
