Judge James Spencer today said he would not impose an immediate injunction against Research In Motion (RIM), maker of the BlackBerry. RIM received a copy of a Final Office Action issued by the U.S. Patent and Trademark Office in the reexamination of NTP, Inc. Patent #5,436,960. This Final Office Action maintains the outright and complete rejection of all claims in the patent.

Research In Motion (RIM) today developed and tested software workaround designs for all BlackBerry handsets operating on converged voice/data networks in the United States. RIM has developed these software workaround designs as a contingency to allow BlackBerry service to continue should the court implement an injunction in the current litigation involving the NTP patents.

Today a federal judge ruled invalid a $450 million settlement between NTP, a small patent holding firm, and the maker of BlackBerry email devices, Research in Motion (RIM). The District Court ruled that the Term Sheet entered between the parties in March 2005 to settle the litigation was not an enforceable agreement.

The Supreme Court denied RIM's motion to stay further proceedings in the case until the U.S. Supreme Court decides whether it will accept an appeal of the decision in this case. The Supreme Court was not asked to, and did not decide, whether it ultimately will accept an appeal of the decision in this case. Rather, the Supreme Court merely decided that it would follow its normal course of allowing the District Court to decide whether and to what extent to continue the litigation in light of all relevant circumstances, including the prospect that the Supreme Court may decide to hear the case. The process by which the Supreme Court will decide whether to hear the case is expected to occur over the next few months. While further review by the Supreme Court is generally uncommon, RIM continues to believe this case raises significant national and international issues warranting further appellate review.

Between 23% and 37% of US wireless subscribers will use a wireless phone as their primary telephone by 2009, reports In-Stat. About 9.4% of US wireless subscribers already use a wireless phone as their primary phone, and compared with earlier surveys, fewer consumers feel that a wired phone is necessary according to the high-tech market research firm.
